Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the Radio94Rec mobile application and services, as well as the Radio94Rec application website located at http://www.radio94rec.com and any content therein (collectively, the "Service").
The Service is operated by T&M Co., Ltd. ("us", "we", "our" or "T&M Co., Ltd").
Unless otherwise specified, all references to the "Service" include the services available through the Radio94Rec mobile application and the Radio94Rec application website, as well as any software that T&M Co., Ltd provides to you that allows you to access the Service from a mobile device.
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

1) Changes to Terms and Conditions
 T&M Co., Ltd may make changes to the content and Service at any time. We can change, update, or add or remove the conditions in these Terms, at any time.

2) Use of the Service
 You may view and use the Service only in accordance with this Terms and Conditions. You agree to use the Service only for lawful purposes and you acknowledge that your failure to do so may subject you to civil and criminal liability, all as determined by applicable law. In order to access some features of the Service, you may be required to create an account. You are not required to submit your name or contact information. We also collect your IP address and collect a unique identifier for your mobile device to improve user experiences in the Service. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. We will not be liable for your losses caused by any unauthorized use of your account.

3) Privacy Policy.
 Please review Radio94Rec Application Privacy Policy (the "Privacy Policy"), available at http://radio94Rec.com/docs/privacy which explains how we use information that we collect from you. By using our Service, you agree that we may use and disclose the information we collect about you as stated in the Privacy Policy. Without limiting the foregoing, you expressly acknowledge that any Submissions (defined below) or other information you submit to the Service may be viewable by all other users of the Service and any third party.

4) Submissions.
 You are responsible for any information, messages, comments, photos and other content or material that you submit, upload, post or otherwise make available on or through the Service (each a "Submission"). We reserve the right to retain your Submissions, even after after you have deleted them. However, you agree that we have no obligation to retain any Submission for any period of time, nor shall we be responsible or liable to you or any third party for any lost content or losses related to the expiration or deletion of a Submission.
You may not upload, post or otherwise make available on the Service any material protected by copyright, trademark, or any other proprietary right without the express permission of the owner of such copyright, trademark or other proprietary right owned by a third-party, and the burden of determining whether any material is protected by any such right is on you.

5) Unauthorized Activities
 You agree not to do any of the following, either directly or indirectly:
 - Use the Service for any illegal purpose, or in violation of any local, national, or international law, including, without limitation, laws governing intellectual property and other proprietary rights, and data protection and privacy;
 - Use racially or ethnically offensive language.
 - Discuss or incite illegal activity.
 - Encourage or enable any other individual to do any of the foregoing.
This list of prohibitions provides examples and is not complete or exclusive. T&M Co., Ltd reserves the right to (a) terminate access to your account, your ability to post to the Service (or use the Service) and (b) refuse, delete or remove any Submissions; with or without cause and with or without notice, for any reason or no reason, or for any action that T&M Co., Ltd determines is inappropriate or disruptive to the Service or to any other user of the Service.

6) Change, Suspension or Termination of App, Services or Your Use
 - We may, without prior notice, change the Service, stop providing the Service, or create usage limits for the Service.
 - We may permanently or temporarily terminate, limit or suspend your access to the Service without notice or liability, for any reason or for no reason.
 - We may make changes to the materials, features, contents available on the Service at any time without notice.

7) Intellectual Property
  T&M Co., Ltd respects the intellectual property rights of others, and we ask you to do the same. We may, in appropriate circumstances and at our discretion, terminate service and/or access to the Service for users who infringe the intellectual property rights of others.

8) Disclaimer
 The Service is provided "As Is", "at Your Own Risk" and "As Available" without any warranties whatsoever, express or implied. We assume no responsibility for the accuracy and completeness of the Service.

9) Limitation of Liability
  T&M Co., Ltd shall not be liable to you for any damages resulting from your displaying, copying, or downloading any materials to or from service. In no event shall T&M Co., Ltd be liable to you for any indirect, extraordinarily, exemplary, punitive, special, incidental, or consequential damages (including loss of data, revenue, profits, use or other economic advantage) however arising, event if T&M Co., Ltd knows there is a possibility of such damage.
